A Relationship-Driven Process, Wherever You Are

Our process is fully remote, so we work effectively with clients regardless of where they live. We communicate fluently in both English and Spanish, which matters when family members, advisors, or assets are located across the Americas.

We don’t approach trust planning as a one-time transaction. Families with substantial estates need counsel that stays current with their circumstances over time, and we build those long-term partnerships intentionally. Every engagement is handled with discretion and a focus on your long-term goals, not just your immediate document needs.

Revocable Living Trusts Under Florida Law

Florida Statute 736.0602 provides that a trust is revocable by default unless the document states otherwise. As the settlor, you retain full authority to amend, modify, or revoke the trust at any time during your life. That flexibility makes a revocable living trust a practical foundation for most estate plans, one you can update as your family or financial situation changes.

For Coral Gables families, the interaction between a funded trust and Miami-Dade County probate is a practical consideration we address directly. Property properly titled in a revocable living trust generally avoids the court-supervised probate process in Florida. Our planning also accounts for Florida’s homestead protections, which carry specific rules about how residential property can be held and transferred.

Cross-Border Trust Planning for Latin America, the Caribbean, & Central America

Many of our clients have family members, real property, or financial accounts outside the United States, across Latin America, the Caribbean, and Central America. A Florida revocable living trust can serve as a strong domestic foundation, but families with cross-border interests need to coordinate that trust with the succession rules and tax systems of the other jurisdictions involved.

We integrate trust and estate planning with both domestic and international tax strategy rather than treating them as separate engagements. Our living trust lawyers understand how cross-border succession planning interacts with the trust structure, and we build that coordination in from the beginning rather than leaving it as an afterthought.

How a Revocable Living Trust Works

How a Revocable Living Trust Works

A revocable living trust is created when a settlor, the person establishing the trust, transfers property into the trust and sets out written terms for how that property is to be managed and distributed. The settlor typically serves as trustee during their own lifetime, retaining day-to-day control over the assets. A successor trustee named in the trust document steps in upon the settlor’s death or incapacity. That successor can be an individual, such as a family member or close friend, or a corporate trustee, such as a bank or trust company.

Because the trust remains revocable, the settlor can amend or revoke it at any time. This distinguishes it from an irrevocable trust, which generally can’t be undone after it is signed.

Privacy & Multi-State Probate Avoidance

Probate is a court-supervised process and becomes part of the public record. A funded revocable living trust generally remains private, since the distribution of trust assets doesn’t go through the courts.

For clients who own real estate in more than one state, probate exposure multiplies. Each state where real property is titled in the settlor’s individual name typically requires its own separate probate proceeding. Consolidating those properties into a single revocable living trust can help avoid those additional proceedings.

Trust Funding: Retitling Your Assets

A revocable living trust only governs assets that have been formally transferred into it. Property left in the settlor’s individual name at death may still require probate, regardless of what the trust document says. Funding the trust means retitling real estate, bank accounts, investment accounts, and other assets in the name of the trust.

We include a pour-over will as part of our trust-based estate plan. This document captures any assets inadvertently left outside the trust and directs them into it, keeping the overall plan aligned even when funding is incomplete.

What a Revocable Living Trust Does Not Do

Setting accurate expectations is part of honest planning. Because the settlor retains control of a revocable living trust during life, the assets held inside it remain reachable by the settlor’s creditors. The trust doesn’t provide the asset protection that certain irrevocable trusts can offer.

For estate tax purposes, the value of assets held in a revocable living trust counts toward the settlor’s taxable estate. Clients with estate tax concerns often need a combination of planning tools, and a revocable living trust is typically one part of a broader strategy rather than the whole answer.

“To compel a man to furnish funds for the propagation of ideas he disbelieves and abhors is sinful and tyrannical.”
